The Magnificent Twofer: Illegal Aliens and Courts

President George W. Bush and Homeland Security Secretary Chertoff made speeches about deporting every illegal alien - all 11 million plus and counting. Except, there would be a six year amnesty period for illegals who register – so they can get their anchor babies born. And the Border Patrol will be bolstered by a thousand plus new agents with new hardware. So, the President and his people were just ‘funning’ us. It’s impossible that they think we think they’re thinking seriously. No way. But, what if we took them at their word? What an opportunity for a strategic political stroke! A magnificent ‘twofer’.

America could fix the illegal alien problem and realign, if not correct, judicial tyranny at the same time. It takes the U.S. Constitution, a one vote majority in both houses of the U.S. Congress, vision and courage. So, maybe those conditions make it impossible this year. Maybe a different kind of Republican majority can be gained in the 2006 elections. It’s worth a try.

The Great Twofer begins with the bills to create and fund the government agencies and logistics to close the border, find 11 million aliens and, after a year of preparation, start deporting 40,000 aliens a week for 50 weeks a year until the mission is completed. The first emphasis is get control of the borders. The National Guard, deputies and volunteers could be rushed to the borders and every point of entry. Tens of thousands of border guards must be hired to replace the temporary force on the national frontier. Setting up the new courtrooms for hearings, preparing holding areas, like older motels, for families and hiring many new judges and judicial staff will take time and money. Take this expansion of the judiciary as the opportunity to fix Judicial tyranny.

Under Article III of the U.S. Constitution the Congress should disband the Federal District and Appeals Courts and establish a new judicial organization “in such inferior courts as the Congress may from time to time ordain and establish.” Include a law, a Judicial Reform Act, to reorganize the Judiciary to deal with epochal changes of illegal immigrant invasion and Islamist terrorism.

Establish special courts for immigration.

Establish special courts for homeland security to deal with terrorism issues.

Establish the rules for the President to reappoint some of the old judges to the new Federal District, Appeals, Immigration and Homeland Security Courts.

The liberal judges who legislate from the bench, like the nutty Ninth Court of Appeals, who lack Constitutional “good behaviour” of judicial restraint will be retired.

Make clear which cases go to which courts. Severely limit judicial review of the Immigration and Homeland Security Courts. For example, don’t grant U.S. citizens’ rights to aliens. While we have the opportunity, restrict the limits of judicial review for First Amendment rights for the free exercise of religion. Strip the authority from the courts to end their cultural cleansing of Christianity from public places.

Finally, appropriate the billions of dollars to carry out the plan. Judicial Tyranny will be set back for a generation, or until the Liberals become a majority and try to do the same thing in the future. As the pool of illegal immigrants dries up, watch the minimum wage rise and unemployment drop based on market forces. The twofer becomes a trifecta.

Consider the other great twofer - privatizing Social Security and un-funding the Federal non-defense spending. If you put the full 12.4% of Social Security payments into personal savings and pay for grandfathered socialist security with the current taxes, the Federal non-defense spending dwindles.

Both twofers demand a sense of timing as much as vision and courage. The problems of illegal immigrant invasion, Islamist terrorism, socialist Social Security bankruptcy, and crushing Federal Debt won’t improve with age. Likewise, the healthcare costs of Medicare and Medicaid, only get worse. It’s folly upon folly to take half measures because politicians fear a moment of courage will cost them their jobs. Maybe, it’s time to vote in some new politicians.

What a day it would be when the legislation for the Great Twofer passed each House of Congress! Two Gordian knots would be cut in one swift stroke. The day of Presidential signing would crystallize for this coming century, like the Fourth of July for our founding, the purpose of the Nation. Homeland Security was made secure by asserting our sovereignty for our borders against invasion and over the courts against tyranny. Go for another trifecta – social security, federal healthcare and spending.
